These General Contracting Conditions shall expressly regulate the commercial relations arising between AHUMADOS DOMÍNGUEZ, S.A. (hereinafter, AHUMADOS DOMÍNGUEZ) and any user or customer who contracts the products offered on its website, which for all legal purposes shall be deemed a contract of sale. These terms and conditions have been drawn up in accordance with current legislation on the matter and, specifically, pursuant to the provisions of Act 34/2002, on Information Society and Electronic Commerce Services; Act 7/1998 on General Contracting Conditions; Royal Decree 1906/1999, which regulates telephone or electronic contracts in development of article 5.3 of Act 7/1998; Royal Legislative Decree 1/2007 or the Revised Text of the General Law on the Defence of Consumers and Users and other complementary laws; Act 7/1996 on the Regulation of Retail Trade and Act 59/2003, on Electronic Signatures, principally.

Both browsing of this website and the purchase of any of the products shown therein imply acceptance as a user, with no reserve of any kind, of each and every one of the following General Conditions, as well as, where applicable, of the Particular or Specific Conditions as determined by the type or nature of the product purchased.

The foregoing shall not apply to companies/businesspersons that are not valid end-consumers.

USER REGISTRATION

Prior to the formalisation of any commercial relationship via this website, clients or users will need to register on the same. Users can register by filling in the form provided for this purpose.

By registering as a user and placing orders via the website you are agreeing to:

      • Use this website only for legally valid enquiries or orders.
      • Not to make any false or fraudulent orders. If it could reasonably be considered that such a false or fraudulent order has been made, we shall be entitled to cancel it and report the matter to the corresponding authorities.
      • Truthfully and accurately provide us with your email address, postal address and/or other contact details. Likewise, you agree that we can use that information to contact you if necessary (see our Privacy Policy).

If you do not provide us with all the information that we need, we will not be able to process your order.

By placing an order via this website, you are declaring that you are over 18 years of age and have the legal capacity to enter into contracts.

You may unsubscribe from our website at any time, but this will never have a retroactive effect.

PRODUCTS AND QUALITY

At AHUMADOS DOMÍNGUEZ we only work with top quality raw materials and ingredients. We take meticulous care over every stage of our production process in order to offer a top quality product and to uphold our high food safety standards.

Our products are the result of a crafted production process. This means that no two products are the same, hence the weights stated on each product are, in all cases, very approximate.

The prices associated to the products are given in Euros (€), and include Value Added Tax (VAT), as well as any other applicable taxes.

SHIPMENT POLICY

Domínguez products will be shipped by SEUR FRÍO, guaranteeing that the cold chain is never broken under any circumstances and deliveries are preferably made before 1.30 pm to ensure that your order arrives in the best possible conditions. In the event of any incident, the maximum delivery deadline is 5 working days.

Orders placed from Monday to Thursday before 1.00 pm will be delivered the following day, apart from special orders that require exclusive preparation (such as Pre-Cut Smoked Salmon in two pieces).

Orders placed from Monday to Wednesday after 1.00 pm will be processed the following day and will be delivered on the following working day.

Orders received from Thursday at 1.00 pm until Sunday will be processed on the Monday after in order to guarantee freshness and guarantee the cold chain of all products. All orders made at the weekend will be delivered the following Tuesday.

Orders received on the eve of public holidays or on public holidays will be processed on the first working day afterwards, provided that the following working day is not a Friday. In that case, the order will be processed from the Monday after.

In the case of Peninsular Spain shipments are made within approximately 24/48 hours (working days). The shipping fee is €5.90. If the total cost of all the products in the order is over €60, shipping is free of charge.

In the case of the Balearic Islands shipments take approximately 72 hours (working days). The shipping fee is €12.80 and shipping is free of charge if the order is for more than €120.

We do not ship to the Canary Islands, Ceuta or Melilla.

To guarantee their total freshness, our products are shipped in collaboration with specialised transport companies that uphold the optimal refrigeration conditions throughout the entire journey, from the moment they leave our site until they are delivered.

At Christmas time, or any other periods that AHUMADOS DOMÍNGUEZ considers for the purposes of its commercial logistics, the right is reserved to establish a later delivery deadline.  AHUMADOS DOMÍNGUEZ may also suspend the Online Store service at its own sole discretion.  In any case, whenever this consideration applies, the special conditions will be published in a visible and prominent place on the website.

Once you have placed your order and you have received the confirmation email, you will receive a second email when the product leaves our premises with the corresponding tracking number and link so that you can easily follow the progress of the delivery on the transport operator’s website.

AHUMADOS DOMÍNGUEZ undertakes to comply with these delivery conditions, always subject to product availability.  If there is no stock, you will be informed of the estimated delay period, and the amount paid may be refunded.

AHUMADOS DOMÍNGUEZ shall not be held responsible for any delay in the order caused by problems with third parties (for example, the shipping company) or for causes outside of the company’s control, such as acts of God or force majeure.

AHUMADOS DOMÍNGUEZ will, insofar as possible, write an email to the customer specifying the estimated delivery period and time.

AHUMADOS DOMÍNGUEZ will provide the shipping company with your delivery details for the sole purpose of ensuring that your order is delivered properly.

REIMBURSEMENTS AND COMPLAINTS

You may return an order, provided that it was defective on arrival or there was an error with the delivery. To do so, you must take a photograph showing that the product is defective and send it to tienda@ahumadosdominguez.es, which will assess the incident internally.

In order to make a return, please follow the steps below:

      • Send a photograph that was taken no later than 12 hours after the delivery arrived, and which proves that the product was defective.
      • The photograph should be accompanied by an explanation of why the product is to be returned.
      • The customer must provide AHUMADOS DOMÍNGUEZ with the defective product if requested to do so.
      • Once the invalid or defective condition of the product has been verified, AHUMADOS DOMÍNGUEZ will cover the delivery costs and reimbursement.
      • The full amount corresponding to the products to be reimbursed, as well as their delivery costs will be paid to the customer by the same method as the one by which the order was paid.

Except for cases of defective products and/or erroneous deliveries, due to the nature of most of our products, which require sealed packaging and control of the cold chain, returns are NOT accepted.

Returns are also accepted in the unlikely event of the product not meeting the quality standards that Ahumados Domínguez guarantees. In such a case, you must send an email to tienda@ahumadosdominguez.es with the reason for the return and corresponding photographs as specified above. Following an individual analysis of your case, we will inform you as soon as possible of the steps to be taken.

METHOD OF PAYMENT

Payment can be made by credit or debit card. The payment will be validated in the very instant that it is made.

We request your details so that we can process your order, and AHUMADOS DOMÍNGUEZ guarantees that this data will be transmitted via a secure, encrypted connection that is protected pursuant to the Secure Socket Layers (SSL) protocol. (See Legal Notice)

No payments may be made with a false or fraudulent card. If there are reasonable grounds to consider that such an order has been made, AHUMADOS DOMÍNGUEZ is authorised to cancel it and inform the corresponding authorities.
