LEGAL SCOPE
The second section of article 22 of Law 43/2002, from 11th July, on information society services and e-commerce (hereafter, LSSI as per its Spanish acronym), in relation to the EU Regulation 2016/679 from 27th April 2016, on General Data Protection (hereafter, GDPR), and the Organic Law 3/2018 from 5th December, Data Protection and Guarantee of Digital Rights (hereafter LOPDGDD as per its Spanish acronym) establishes that:
- Service providers may use data storage or recovery devices on user terminal equipment, providing that the users have granted their consent thereto after been provided with clear and concise information on how their data will be used, and in particular, why their data will be processed, in accordance with the regulatory provisions on Personal Data Protection.
- When technically possible and effective, the users’ consent in accepting the processing of their data may be made using the parameters permitted on their browser or other applications.
- The foregoing will not prohibit possible technical storage or access when it comes making communications via any particular social network, or, whenever strictly necessary, for the rendering of any information society service expressly requested by the user.
The GDPR, in clause 30, mentions this technology and its impact on data protection, indicating that individuals may be associated with online identifiers provided by their devices, apps, tools, and records, as well as internet address records, session identifiers in the form of «cookies», or other identifiers, such as radio-frequency identification tags. This may leave digital footprints that, especially when combined with unique identifiers and other data received by servers, can be used to create the profiles of individuals and to identify them.
This cookies policy has been reviewed in compliance with the new cookie use regulations published by the Spanish Data Protection Agency (AEPD, as per its Spanish acronym) on 28th July 2020, amending the Guide on the use of cookies to adapt it to the Guidelines on consent amended in May 2020 by the European Data Protection Board (EDPB) (Guidelines 05/2020) on consent. Specifically, technical measures have been undertaken to ensure that the “continue browsing” option is not configured as a consent option and does not have a “cookie wall” implemented therein.

Persistent cookies: these are those which still store the data on the device and can be accessed and processed during a period of time defined by the responsible party for the cookie, which may vary from a few minutes to a few years.
